DUI and Traffic Cases

Criminal Defense - DUI and TRAFFIC CASESLooking for a DUI/DWI Defense Attorney in Colorado Springs? Brian Boal is well experienced in DUI and DWI cases. Regrettably, many people believe an arrest for drunk driving/DUI or other serious traffic offense is no big deal and something they can handle on their own without an attorney or legal representation.  The fact is that in many cases a conviction on these charges can negatively impact your life for years into the future, and result in penalties including fine(s), suspension or loss of driver’s license/driving privileges, and jail sentences.

Don’t be one of these many people.  Take charge of the situation by hiring a lawyer who can take charge of the situation for you, and has the knowledge and experience in southern Colorado to do so effectively.  As a former Colorado Springs and Teller County prosecutor managing a weekly criminal docket as recently as November 2010, Brian Boal regularly appeared before the judges of the Fourth Judicial District and is generally familiar with the rules and procedures in El Paso County courts and this jurisdiction.  His background and experience as a district attorney allow him to effectively negotiate a plea deal that is right for you and get you the best possible plea offer available while minimizing your legal fees, or take your case to trial if necessary and aggressively defend you in front of a judge or jury.

To those with no legal background, the courtroom can be an intimidating and scary place.  Unfortunately, following their court appearance, people are often left without any real understanding of what is happening in their case or what their options are.  As a result, the unrepresented citizen/defendant is frequently unable to make important decisions to effectively defend against pending criminal charges in front of hearing officers and county court judges.

As a prosecutor, Brian Boal was selected, attended and received certification from the National Advocacy Center for district attorneys, completing their trial advocacy program.  He has a working knowledge of the first appearance center, arraignments, Department of Motor Vehicle (DMV) hearings for license suspension, pretrial conferences and plea dispositions, trial readiness and numerous motions to suppress based on a suspect’s constitutional rights under the Fourth, Fifth, Sixth, Fourteenth Amendments, and other applicable Amendments of the United States Constitution and Constitution of the State of Colorado, motions in limine and motions to exclude/quash evidence, bills of particulars, similar transactions evidence, discovery, sentencing, and post-conviction motions.  He understands the elements and burden proof needed for the jury for traffic offenses and traffic misdemeanors including driving under the influence of alcohol and/or drugs (DUI; DUID); driving while ability impaired (DWAI); driving under restraint/suspension; careless and reckless driving, no proof of insurance; speeding, leaving the scene of an accident, stricter penalties for more serious offenses like vehicular elusion, careless driving resulting in death, vehicular assault, and vehicular homicide, as well as issues such how points affect your license status, and the additional consequences a convictions can have for persons with multiple prior DUI convictions and/or traffic offenses on their driving record and those persons possessing commercial drivers’ licenses.

Moreover, Brian has received specialized training from the Colorado Springs Police Department and other local, state, and federal law enforcement agencies and has an extensive background in officer/arrest-related procedures for traffic stops where the driver is suspected of being intoxicated; including the probable cause and reasonable suspicion standards and indicia of intoxication, search incident to arrest, warrant requirements, voluntary roadside maneuvers/roadside sobriety tests, breath and blood testing for blood alcohol content including use of the Intoxilyzer/breathalyzer device by police for testing intoxication levels, suspect consent requirements, and impoundment and inventory searches of vehicles.
